dc.description.abstract CHAIRPERSON'S FOREWORD) On l3s November 2}20,the National Assembly Departmental Committees on Defence & Foreign Relations and Lands convened a workshop in Mombasa to deliberate on Ministry of Defence land disputes and related security. The Cabinet Secretaries Ministries of Defence and Lands & Physical Planning, together with representatives of t the National Land Commission and officials from the Attorney General's office, participated in the workshop. During the workshop, the Ministry of Defence officials sought the intervention of the Committees in fast-tracking the resolution of land disputes involving parcels of land reserved for the military. The Committees recommended the establishment of an ad-hoc Sub-Committee comprising Members of the two Committees to investigate and recommend interventions required to hasten the resolution the land disputes related to the ownership of various parcels of land and the other security challenges arising from the same. The Joint Committee embarked on investigating the land disputes and related security challenges with the following terms of reference: a. To identity the specific Ministry of Defence parcels of land with disputes, the nature of the disputes and the related security challenges. b. To determine the companies claiming part of the land Ministry of Defence land and the nature of the said claims c. To suggest recommendations to fast track the resolution and disputes and address the related security challenges While considering the matter the Committee: 1. Met technical officers from the Ministries of Defence and Lands & Physical Planning, the office of the Attomey General and the National Land Commission on l9m January 2021. 2. Undertook a field visit to Embakasi Garrison on 2l't January 2021 and Moi Airbase Eastleigh on 26th Jaruary 2021 3. Met representatives of the Office of the Attorney General, Ministry of Defence, the National Land Commission and the Ministry of Lands and Physical Planning on lls February 2021. The officers briefed the Committee on cases pending in court related to Ministry of Defence land during the meeting. 4. Heard from Capt. Gilbert M. Kibe Director General Kenya Civil Aviation Authority on 1lft February 2021. 5. Met the Deputy Director-General, Nairobi Metropolitan Service, the Chief Officer, Lands Planning, Housing Urban Renewal & Project Management and Chief Executive 5 Committee Member for Lands, Nairobi City County Govemment, on behalf of the Director-General and the Ag. Governor, Nairobi County, on Tuesday 2nd March 2021. 6. Received a report from a multi-agency team comprising representatives of the Nairobi Metropolitan Services, Nairobi City County Government, Ministry of Defence, Ministry of Lands & Physical Planning, Office of the Attorney General and the National Land commission a report to the committee on 25th March z02l onTe July zo2r. 7. Met Mr Benard Koyyoko and Capt Rtd Kenneth Boit, Directors of Torino Enterprise Limited and Darkwood Investment Ltd on 17ft November 202I and held a follow-up meeting with the two directors on 2nd December 2021 The Committee is thankful to Cabinet Secretaries and officials Ministries of Defence and Lands & Physical Planning, Officers from the Office of the Attomey General and the National Land Commission, the Director General Kenya Civil Aviation Authority, the Deputy Director-General, Nairobi Metropolitan Service, the Chief Officer, Lands Planning, Housing Urban Renewal & Project Management and Chief Executive Committee Member for Lands, Nairobi City County Government, the Directors of Torino Enterprise Limited and Darkwood Investments Ltd. The Committee is thankful to the Offices of the Speaker and the Clerk of the National Assembly for the logistical and technical support accorded to it during its consideration of the mattter. Pursuant to the provisions of Standing Order lg9, it is my pleasant duty to table the Report of the Joint Departmental Committees on Defence & Foreign Relations and Lands on resolving selected Ministry of Defence land disputes and related security challenges.
